Subject: Affirmation of Rights - Notice of Action

Aloha,
On September 30th, 2002 I served legal notice to your government of my intent to protect and defend all human rights protected by the Universal Declaration of Human Rights (UDHR) and all other applicable human rights laws. The reasoning of this is expressed well by the preamble of the UDHR.

UNIVERSAL DECLARATION OF HUMAN RIGHTS
'Whereas recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world,&'

Specifically I informed your government of my intent to exercise and defend three specific rights that are, according to law, 'inalienable' and 'inherent' in all human beings. Specifically;

1. The Human Right of Self Determination
International Covenant on Civil and Political Rights - Article 1
'All peoples have the right of self-determination. By virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development.'
2. The Human Right to Travel
Geneva Convention on Refugees - Article 27 & 28 (Identity Papers, Travel Documents)
'Article 27 - The Contracting States shall issue identity papers to any refugee in their territory who does not possess a valid travel document.'
'Article 28 - The Contracting States shall issue to refugees lawfully staying in their territory travel documents for the purpose of travel outside their territory, unless compelling reasons of national security or public order otherwise require,'
3. The Human Right to Equal Work for Equal Pay
Universal Declaration of Human Rights - Article 23
(1) 'Everyone has the right to work, to free choice of employment, to just and favourable conditions of work and to protection against unemployment.
(2) Everyone, without any discrimination, has the right to equal pay for equal work.
(3) Everyone who works has the right to just and favourable remuneration ensuring for himself and his family an existence worthy of human dignity, and supplemented, if necessary, by other means of social protection.'

It appears however that this notice has gone unheeded. It also appears, as if the Dutch Government, like the United States Government, considers human rights some sort of abstract nicety, clearly your government has no intent to honor these rights, certainly not in my case. Your government dishonorably considers me an American despite my right to Self Determination and my exceedingly well documented renunciation of United States citizenship. Your government refuses to provide travel papers as mandated by the Geneva Convention. And last but not least, I, along with every refugee I am aware of in Holland, am denied the right of equal work for equal pay. Understanding these facts I cannot escape another fact, the fact that you may well injure more of my human rights. Specifically the following;

Geneva Convention on Refugees - Article 33
Prohibition of expulsion or return ("refoulement")
1. No Contracting State shall expel or return ("refouler") a refugee in any manner whatsoever to the frontiers of territories where his life or freedom would be threatened on account of his race, religion, nationality, membership of a particular social group or political opinion.

I consider the possibility of having this right injured by your government as completely unacceptable. I will not invite the possibility of this injury and the fact is that foreign policeman C.J. v. Triest, and his superior have informed me that although I have physically checked in with them, they are compelled to officially not check me in. This is because I have relinquished the Dutch identity card that injuriously lists me as an American. Therefore, if your government refuses to acknowledge me once more on account of my refusal to be identified as American, I simply will not report to the foreign police any longer.

I am so clearly not an American so what assurance do I have that your police will not apprehend me and forcibly send me back to the same United States I am seeking asylum from? The answer to that question is I have no assurance whatsoever. I am now forced into hiding in order to avoid the possibility of "refoulement." Furthermore, since I am not officially being checked in I will wait for my court date without checking in and I will then argue my case for asylum in a Dutch court rather than with your government. My attorney MR DRS P.B.PH.M BOGAERS is the only person that I can be contacted through and this may have delays, as a life in hiding will not be easy.
